Terms of Service

1. Acceptance of Terms

By accessing or using Otography ATL’s website, services, communications, or media (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must discontinue use of our Services immediately.

2. Copyright & Intellectual Property

All photographs, videos, 3D tours, floor plans, graphics, designs, text, logos, and other creative works provided by Otography ATL (“Content”) are protected under U.S. copyright law and international treaties. Unless explicitly licensed in writing, Otography ATL retains full copyright ownership of all Content. Clients are granted a limited, non-exclusive, non-transferable license to use delivered Content solely for real estate marketing purposes relating to the specific property for which the media was created. Content may not be resold, relicensed, altered, or reused for unrelated properties without prior written consent. Unauthorized use of Content may result in additional licensing fees, termination of access, and legal action.

3. SMS & MMS Messaging Disclosure

By providing your mobile number and opting in, you consent to receive SMS (text) and MMS (multimedia) messages from Otography ATL regarding your bookings, confirmations, service updates, and promotional offers. Message frequency varies by user activity, and message and data rates may apply depending on your carrier plan. To opt out, you may reply STOP to any message, and to request assistance, reply HELP. Your number will not be sold or shared with unaffiliated third parties for their marketing purposes without your consent. By opting in, you represent that you are the account holder or have the account holder’s consent to receive messages.

4. Service Terms & Client Responsibilities

Scheduling is subject to availability and confirmation. Clients are responsible for ensuring properties are photo-ready at the time of the scheduled shoot, and additional fees may apply for delays, reshoots, or cancellations. Final media delivery timelines are estimates but generally provided within the timeframe stated at booking. Clients are responsible for compliance with MLS, brokerage, and advertising rules when using Otography ATL’s Content.

5. Payments & Fees

Payment terms are due as specified at booking unless otherwise agreed in writing. Late payments may result in suspension of delivery and additional fees. All sales are final unless otherwise required by applicable consumer protection law.

6. Limitation of Liability

Otography ATL is not liable for indirect, incidental, or consequential damages arising from use of Services or Content, nor for losses due to property conditions, staging, or third-party platform limitations such as MLS, Zillow, or social media. Service delays caused by force majeure, internet outages, or circumstances beyond our control are not the responsibility of Otography ATL. Our total liability for any claim shall not exceed the amount paid for the specific Service giving rise to the claim.

7. Indemnification

You agree to indemnify and hold harmless Otography ATL, its employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses, including attorney’s fees, arising from your use of the Services or Content, your violation of these Terms, or your infringement of third-party rights.

8. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your information, including SMS and MMS communications.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Fulton County, Georgia.

10. Updates to Terms

Otography ATL may update or revise these Terms at any time by posting the updated version on our website. Continued use of the Services constitutes acceptance of the revised Terms.
